Initial Training of Magistrates is addressed to Substitute Labour Judges during probationary period. Its objective is to provide judges with specific training to work in the judicial system, developing the needed skills to the good practice of the judicial activity. The subjects and contents which are inherent to the practice of a judge's duty are not given at Law School, neither at post-graduation Law Course, such as magistracy deontology, logic of law decision and forensic language, communication and psychology, judicial conciliation techniques and judiciary administration. The Initial Formation Course is a statutory requirement for a judge to be appointed for life and it is divided in two modules: national and regional.

The national module held at Enamat headquarters in Brasilia lasts at least four weeks. It is designed to recently appointed judges of all Regional Labour Courts (TRTs) who, after taking office, are at first assigned as Enamat's students. In this module, the specialized professional training model is developed. Also, the most advanced teaching techniques, shared by outstanding Magistracy Schools all over the world, are delivered to the students.

The regional module, in turn, shall be taken after the conclusion to the national one. This module will take place at the Regional Judicial Schools where the Substitute Judges belong to and lasts for the remaining probationary period. It goes deeper in the specific subjects needed to the performance of a judge's role, and also integrates the judge into the reality of the community of his/her new workplace.

 

Disciplines – minimum content

 

I – Applied Professional Deontology: study of the ethical aspects which involves judicial activity, judge's behaviour and the philosophical groundings of the legal order;

II – Judicial Decision Technique: study of the legal logic proceedings to the decision-making in the Labour Judiciary;

III – Judiciary System: analysis of the fundamental aspects of the organic, institutional and systemic insertion of labour judge in the Judiciary branch;

IV – Judicial Administration: study of the management aspects of the judiciary activity (management of people, material and workflows);

V – Judicial Administration: study of the management aspects of the judiciary activity (management of people, material and workflows);

VI– Judicial Conciliation Technique: study of proceedings, postures, behaviour and mechanisms able to obtain conciliated solution of labour conflicts;

VII – Applied Judicial Psychology: analysis of relationships, of subjectivity of Judge and of relevant categories of psychological dimension to the practice of the legal profession;

VIII – Relationship to Society and the Media: study of the relationship of Magistrate to the means of social communication and to society;

IX – Contemporary Issues in Law: study of most relevant issues in law debated nowadays in society;

X – Effectiveness in Labour Execution: analysis of proceedings to assure celerity and conclusion of executions in the labour jurisdiction;

XI – Judicial Laboratory: judicial management, decision and instruction workshops to the practice and simulation of experienced situations in profession.

Beside those basic disciplines, complementary ones will be offered in the course syllabus of the initial formation course, according to the annual planning of activities of the School.

 

Institutional Internship

During the course students visit and watch sessions in several institutions of the Federal Capital, in order to gain practical knowledge about the functioning of these institutions. Among others and according each course schedule, there are visits to Chamber of Deputies, Federal Senate, Civil Cabinet at the Presidency of the Republic, Labour Attorney General's Office, Federal Council of Brazilian Bar Association, National Council of Justice, Higher Council of Labour Justice, and Superior Labour Court.
